Welcome to www.flowell.com (the "Site"), operated by Wellcosan Inc doing business as Flowell ("Flowell," "we," "our," or "us"). By accessing and using this Site, you agree to these Terms and Conditions ("Terms"), which govern your interaction with our Site, products, and services. If you do not agree to these Terms, please do not use this Site.

 

1. Acceptance of Terms and Changes

By using this Site, you confirm that you accept these Terms and agree to abide by them. Flowell reserves the right to update or modify these Terms at any time without prior notice. Any changes are effective immediately upon posting, and significant updates will be highlighted for 30 days to allow for review. Continued use of the Site following any changes constitutes acceptance of the revised Terms.

2. Ownership, Copyright, and Trademarks

All content on this Site—including text, images, logos, and video clips—is the exclusive property of Flowell or its licensors and is protected by U.S. and international copyright and trademark laws. You may download or print content for personal, non-commercial use only. Unauthorized reproduction, modification, or distribution of Site content is strictly prohibited.

3. Contract Formation

3.1 Offer and Acceptance  

   Adding items to the cart and completing the checkout process constitutes an offer to purchase. A legally binding contract is formed upon our acceptance of this offer, which occurs when you receive a confirmation email from us.

3.2 Contract Confirmation  

   A confirmation email will summarize your order. Please review it carefully and inform us immediately of any discrepancies.

4. Payment Terms

4.1 Accepted Payment Methods  

 We accept major credit cards (Visa, MasterCard, American Express), PayPal, and other payment methods listed at checkout. All payment transactions are securely encrypted.

4.2 Authorization  

   By providing payment details, you confirm you are authorized to use the payment method. If a transaction is declined, we reserve the right to cancel the order and will notify you via email.

5. Product Details and Disclaimers

Flowell strives to ensure the accuracy of all information presented on this Site. However, we reserve the right to correct any errors, inaccuracies, or omissions, including but not limited to pricing, product descriptions, and availability, without prior notice. Flowell may modify or update information at any time, even after an order has been placed. If an error or inaccuracy significantly affects your order, Flowell will notify you with the option to confirm or cancel your order. In such cases, Flowell shall not be liable for any losses or damages arising from the correction of such errors.

5.1 Description Accuracy

   We strive for accuracy in product descriptions; however, discrepancies may occur. In such cases, your remedy is to return the product according to our Return Policy.

5.2 Color Representation

   Product colors may vary slightly from those shown on the Site due to display differences. If unsatisfied with a product’s appearance, you may return it in accordance with our Return Policy.

 

6. Medical Advice Disclaimer

Information provided on this Site is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a healthcare professional before using our products for any health condition.

7. Return Policy and Cancellations

7.1 Returns  

   Products may be returned within 30 days of delivery. Items must be unused, in original packaging, and returned at the customer’s expense unless the item was defective upon arrival. Certain sale items may be non-returnable, as indicated at purchase. Our return policy with specific steps for returns and timelines for refunds can be found in our Helpcenter.

7.2 Refunds 

   Refunds are processed to the original payment method within 10 business days of receiving the returned item. Restocking fees may apply to items not meeting the stated conditions.

7.3 Cancellations  

   Orders may not be canceled after orders have been placed, Please contact our customer service at support@flowell.com for instructions. Orders fall under the Return Policy.

8. Ownership Retention and Risk of Loss

All products remain the property of Flowell until full payment is received. For consumer sales, the risk of loss transfers to the buyer upon delivery. For business sales, the risk transfers when the carrier takes possession of the goods.

9. Account Responsibilities

If you create an account, you are responsible for keeping your username and password confidential. You accept responsibility for all activities that occur under your account and agree to notify us of any unauthorized access.

10. User Content and Feedback

By submitting any comments, reviews, feedback, suggestions, or other content ("User-Generated Content") to Flowell, you acknowledge and agree that this content becomes the property of Flowell. Flowell shall have the unrestricted, perpetual, worldwide right to use, reproduce, modify, distribute, display, and publish any User-Generated Content without compensation to you. This license allows Flowell to use the content in any medium or form, including for advertising and promotional purposes. Flowell also reserves the right to edit, remove, or refuse to display any User-Generated Content at its sole discretion.

We care deeply about your privacy. If you choose to enter health-related information on the Flowell website, such as your swelling patterns, leg measurements, or therapy preferences, rest assured:

• Your data stays with you. We do not share or sell your personal or health-related data with third parties.
• Automatic deletion. Any sensitive health inputs you choose to log are automatically and permanently deleted after 30 days
• Secure storage. While your data is active, it is encrypted and securely stored on GDPR-compliant servers located in the EU

 

11. Limitation of Liability

IN NO EVENT SHALL FLOWELL’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE GREATER OF TWENTY-FIVE DOLLARS ($25) OR THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE THAT IS THE SUBJECT OF THE CLAIM. Flowell is not liable for any indirect, incidental, consequential, punitive, or exemplary damages, including but not limited to loss of profit, goodwill, or data, arising from your use of, or inability to use, the Site or Services. This limitation applies to all claims, regardless of whether Flowell was advised of the possibility of such damages.

12. Indemnity

You agree to indemnify, defend, and hold Flowell, its affiliates, and employees harmless from any claims, damages, or expenses arising from your use of the Site, any violation of these Terms, or any infringement of third-party rights. This obligation survives termination of these Terms and your use of the Site.

13. Links to Third-Party Sites

This Site may contain links to websites operated by third parties that are not under Flowell’s control. These links are provided for your convenience only, and Flowell does not endorse, approve, or make any representations or warranties regarding the content, products, or services offered on these external sites. Flowell is not responsible for examining or evaluating, and does not assume any responsibility or liability for, the actions, content, accuracy, legality, functionality, or privacy practices of any third-party websites. Access to any third-party site linked from Flowell’s Site is at your own risk.

Before engaging in any transaction with these third parties, we recommend reviewing their respective terms and policies, as Flowell has no involvement in and disclaims all liability for transactions conducted with any third-party site.

14. Complaint Procedures

If you believe any content on this Site infringes your intellectual property or other rights, please contact us at support@flowell.com. Include your name, contact information, a description of the content at issue, and a statement affirming your rights in the complaint.

15. Dispute Resolution and Arbitration

All disputes arising under these Terms shall be resolved through binding arbitration, conducted by the American Arbitration Association in New York, New York. By agreeing to these Terms, you waive your right to a trial by jury. Arbitration will proceed under the laws of the State of New York. You may opt out of this arbitration clause within 30 days of accepting these Terms by sending a written notice to Wellcosan Inc., 80 Pine Street, New York, NY 10005.

16. Governing Law and Miscellaneous

These Terms are governed by the laws of the State of New York, representing the entire agreement between you and Flowell regarding Site use and superseding all prior agreements. If any provision is deemed invalid, the remaining provisions will continue to be enforceable.

17. Mobile Terms of Service

By opting into Flowell’s SMS/text messaging service, you agree to receive recurring SMS/text messages, including updates, alerts, and promotional information, to the mobile number you provided. Message frequency may vary based on your interaction with Flowell. Standard message and data rates may apply as per your mobile plan; check with your wireless provider for details. Flowell does not charge for the service but is not responsible for any fees imposed by your wireless provider.

To opt out of Flowell’s SMS service, you may reply "STOP" to any text message received. You may also contact Flowell customer service at support@flowell.com to remove yourself from future SMS communications. Replying "HELP" to any text message will provide additional assistance regarding the service. Please note that opting out of SMS messages does not affect other communication methods you may have consented to.

18. Severability and Waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. The remaining provisions will continue to be in full force and effect to the maximum extent permitted by law.

Flowell’s failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will only be effective if in writing and signed by an authorized representative of Flowell. No waiver of any breach or default shall be deemed to be a waiver of any preceding or subsequent breach or default.

19. Black Friday / Cyber Monday Promotion Terms (2025)

These promotional terms (“BFCM Terms”) apply to Flowell’s Black Friday and Cyber Monday campaigns, including the lead-generation phase, Early Access Day, and all promotional sales from October 31 to December 15, 2025. Participation constitutes acceptance of these BFCM Terms in addition to Flowell’s general Terms and Conditions.

19.1 Lead-Generation Period (October 31 – November 13, 2025)

During this phase, customers may sign up on the designated landing page to receive email notifications and exclusive early access to Flowell’s Black Friday sale.

Registration grants password-protected access to the Flowell store and BFCM offers 24 hours before the public sale begins.

Flowell will not communicate any discount amounts or pricing details during the lead-generation period.

All registrants are automatically entered into a raffle for a refund of the product value of their BFCM order.

One winner will be selected after the campaign ends.

Refund applies only to the order value and will be processed to the original payment method.

Flowell may disqualify fraudulent or duplicate registrations.

19.2 Early Access Day (November 14, 2025)

On November 14, 2025, the Flowell store will be closed to the public and accessible only via password.

Access is restricted to customers who registered during the lead-generation period.

A password will be provided to qualifying registrants to unlock BFCM pricing 48 hours before the official sale start.

Customers who have not yet registered may still sign up on November 13, 2025 (“Closing Day”) to receive last-minute access.

Flowell reserves the right to revoke access for unauthorized password sharing.

Early Access Gift:

 Customers who place an order on November 13, 2025 (Closing Day) will receive an exclusive Early Access gift with their order.

Order-Value Gift:

 While supplies last, customers placing qualifying orders during Early Access or BFCM will receive:

Flowell may substitute gifts of equal or greater value or end gift promotions early due to inventory limitations.

19.3 Black Week / Sale Period (November 15 – December 15, 2025)

During this period, BFCM offers will be applied automatically at checkout:

30% off Sets

25% off Backpacks

All discounts are calculated based on MAP (Minimum Advertised Price).

 Offers are valid while supplies last. Product availability may vary.

Flowell may modify or discontinue individual offers at any time to comply with MAP regulations, inventory constraints, or operational needs.

19.4 Discount Code Use

Discount codes cannot be used during Early Access Day or during the Black Week / Sale Period unless explicitly stated.

Flowell may temporarily disable the discount field at checkout or deactivate codes during promotional periods.

Discount codes cannot be combined with BFCM offers.

19.5 Returns and Exchanges for Promotional Orders

Orders placed during the BFCM period remain subject to Flowell’s standard Return Policy unless otherwise stated.

Gifts received with purchase must be returned unused and unopened if the associated order is refunded.

Flowell reserves the right to deny returns that do not comply with stated conditions.

19.6 Errors and Adjustments

Flowell may correct price errors, adjust inventory availability, or alter promotional terms at any time.

 If an error materially affects a customer’s order, Flowell will notify the customer and offer the option to confirm or cancel.
